These Terms of Use (“Terms”) explain the rules for using the My Benni AI website, mobile applications, and related services (collectively, the “Services”). Please read these Terms carefully before using our Services.
By creating an account or using My Benni AI, you agree to these Terms. If you do not agree with these Terms, please do not use the Services.
About My Benni AI
My Benni AI is operated by Benni Inc. (“Benni,” “we,” “us”). Our platform helps individuals:
- Keep track of their workplace and personal benefits, coverage, balances and deadlines
- Organize receipts, bills, insurance cards and benefit documents
- Submit and track claims and reimbursements
- Manage benefits for themselves and their family members
- Securely share information with employers, benefit providers, insurance companies and other people they authorize
- Better understand their benefits through technology and artificial intelligence
My Benni AI is a technology platform. We do not provide medical care. We are not an insurance company, benefits plan administrator or plan sponsor. We do not provide legal, tax or financial advice, and we do not replace healthcare professionals, benefits administrators or other qualified advisors.
1. Who Can Use My Benni AI
You may use My Benni AI if you are at least 18 years old, can legally enter into a contract, and agree to these Terms.
If you are creating an account for, or adding information about, another person, you represent that you have legal authority to act on their behalf. Examples include a parent, legal guardian, personal representative, or a person acting under a valid power of attorney.
2. Creating an Account
To use certain features, you must create an account. You agree to:
- Provide accurate information
- Keep your information up to date
- Protect your password
- Protect your mobile device
- Notify us if you believe someone has accessed your account without permission
You are responsible for activity that occurs under your account unless the activity results from our negligence or a security incident beyond your control.
3. Member Accounts
Members control their own information. As a member, you decide:
- Whether to connect benefits, insurance or healthcare accounts
- Whether to upload receipts, bills, insurance cards and other documents
- Whether to add family members
- Who may access your information
- When to remove access
You may authorize an employer, benefit provider, insurance company or another person to access information through My Benni AI. You may revoke that authorization at any time unless we are legally required to maintain access or preserve information.
4. Employer and Partner Accounts
Employers, benefit providers and insurance companies that use My Benni AI (“Partners”) may access a member’s information only when authorized by that member or another legally authorized representative, or as permitted by their agreement with Benni and applicable law. Partners remain responsible for complying with their own legal obligations. Partners agree to:
- Access only information they are authorized to receive
- Protect confidential information
- Comply with applicable privacy laws
- Use information only for authorized purposes
- Maintain appropriate security safeguards
5. Health Information Authorizations
Some features require your authorization before we retrieve or share health or benefits information. You may withdraw an authorization when permitted by law. Withdrawal does not affect actions already taken based on a valid authorization.
By using these features, you represent that you have authority to authorize access, the information you provide is accurate, and you understand what information you are authorizing us to access or share.
6. Artificial Intelligence
My Benni AI may use artificial intelligence (“AI”) to help organize information and improve your experience. AI may be used to:
- Read and extract details from receipts, bills and insurance cards
- Organize documents
- Match expenses against your coverage
- Summarize your benefits
- Suggest reminders and ways to use your benefits
- Improve search
AI is designed to assist users. AI does not practice medicine, diagnose illnesses, recommend treatment, provide legal, tax or financial advice, decide whether a claim is covered or paid, or replace healthcare professionals or benefits administrators.
You remain responsible for reviewing important information before making healthcare, benefits, insurance, or financial decisions.
7. Your Responsibilities
You agree to use My Benni AI responsibly. You agree that you will:
- Provide truthful information
- Keep your login information secure
- Upload only information you have the legal right to upload
- Connect only accounts you are authorized to access
- Authorize sharing only when you have authority to do so
- Respect the privacy rights of others
- Comply with applicable laws
You agree not to:
- Impersonate another person
- Interfere with the security of the Services
- Attempt unauthorized access
- Upload malicious software
- Submit false or fraudulent claims or documents
- Misuse the Services
- Violate another person’s privacy
- Use the Services for unlawful purposes
8. Acceptable Use
You may not use My Benni AI to:
- Violate any law
- Harass another person
- Distribute malware
- Interfere with our systems
- Attempt to bypass security controls
- Reverse engineer the platform, except where permitted by law
- Access another user’s information without authorization
We may investigate violations of these Terms and take appropriate action, including suspending or terminating access where necessary.
9. Intellectual Property
The My Benni AI website, mobile applications, software, logos, designs, graphics, text, and other content are owned by Benni Inc. or our licensors and are protected by copyright, trademark, and other laws.
We give you a limited, non-exclusive, non-transferable, and revocable license to use the Services for their intended purpose. You may not:
- Copy or sell our software or content
- Modify or reverse engineer the Services, except where allowed by law
- Remove copyright or trademark notices
- Use our name, logo, or branding without our written permission
You continue to own the personal information, documents, and other content you upload to My Benni AI. By uploading content, you give us permission to use it only as needed to provide the Services you request.
10. Third-Party Services
My Benni AI works with trusted third-party providers to deliver certain features of our Services. Examples include cloud hosting, authentication, email delivery, text messaging, payment processing, mobile services, analytics, AI services, and benefits, insurance and healthcare data connections.
These providers have their own terms and privacy policies. While we carefully select providers that meet our security and privacy standards, we are not responsible for services that are outside of our control.
11. Payments
Some My Benni AI features may require payment now or in the future. If you purchase a paid service:
- You agree to pay the fees shown at the time of purchase.
- You authorize us or our payment processor to charge your selected payment method.
- Prices may change, but we will notify you before changes apply to future purchases.
- Unless otherwise stated, fees are non-refundable except where required by law.
Payments are processed by secure third-party payment providers. My Benni AI does not store your complete payment card information.
12. Medical Disclaimer
My Benni AI is a technology platform. We are not a healthcare provider. Nothing in the Services should be considered medical advice, medical diagnosis, medical treatment, emergency medical care, or a substitute for your healthcare provider.
Always seek the advice of your physician or another qualified healthcare professional for medical questions. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
13. Benefits and Insurance Disclaimer
My Benni AI is not an insurance company, benefits plan administrator, or plan sponsor, and we do not decide whether a claim is covered, approved or paid. Your coverage is governed by your plan documents and the decisions of your employer, plan administrator or insurer. Information in the Services, including AI-generated summaries, balances and reminders, is for informational purposes only. We do not provide legal, tax or financial advice. You should confirm important coverage details with your plan administrator or insurer and consult a qualified professional regarding legal, tax or financial questions.
14. No Guarantee of Results
We work hard to provide accurate and reliable Services. However, we cannot guarantee that:
- Every claim or reimbursement will be approved or paid
- Benefit, coverage and balance information will always be complete or current
- Every employer, provider or insurer will respond
- Every report or reminder will be free from errors
- AI-generated information will always be accurate
- The Services will always be available without interruption
You remain responsible for reviewing important information before relying on it.
15. Limitation of Liability
To the fullest extent allowed by law, Benni Inc. and its officers, directors, employees, contractors, and affiliates will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services. This includes damages related to lost profits, lost business opportunities, lost data, missed deadlines or benefits, service interruptions, or unauthorized access caused by circumstances beyond our reasonable control.
Nothing in these Terms limits liability where the law does not allow it.
16. Indemnification
You agree to be responsible for claims, damages, losses, or expenses that result from your violation of these Terms, your misuse of the Services, your violation of another person’s rights, or information you upload without proper authorization.
This section does not apply to claims caused by our negligence or willful misconduct.
17. Suspension or Termination
You may stop using My Benni AI at any time. We may suspend or terminate your account if:
- You violate these Terms
- You misuse the Services
- Your actions create a security risk
- We are required to do so by law
- Continued access could harm other users or the platform
When reasonable, we will try to notify you before suspending or terminating your account. Some information may be retained after account closure as described in our Privacy Policy.
18. Changes to the Services
We are always improving My Benni AI. We may add features, improve existing features, discontinue features, update supported integrations, or improve security. Some features may change or become unavailable over time. We will make reasonable efforts to notify users of significant changes when appropriate.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice at least 30 days before the updated Terms become effective whenever required by law or when the changes materially affect your rights. We may notify you by email, through the My Benni AI application, or on our website.
The updated Terms will include a new Last Updated date. Your continued use of the Services after the effective date means you accept the updated Terms. If you do not agree with the updated Terms, you may stop using the Services and close your account.
20. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules, unless another law requires otherwise. If any part of these Terms is found to be unenforceable, the remaining sections will continue to apply.
21. Dispute Resolution
If you have a concern about our Services, we encourage you to contact us first so we can try to resolve the issue. Most questions can be resolved quickly by contacting our support team. Nothing in these Terms limits any rights you may have under applicable law.
